Cancellations and Refunds Policy

1. Overview
This Cancellations and Refunds Policy ("Policy") applies to all donations made through the Kindly platform (the "Platform"), operated by CreateTogether Foundation ("we," "us," or "our").
Our goal is to provide a transparent and fair process for handling donations. As a platform facilitating contributions to various causes and campaigns, it's important for Donors to understand our policies regarding cancellations and refunds.
Generally, donations made through Kindly are non-refundable. We encourage all Donors to be sure of their decision before making a donation. However, we understand that exceptional circumstances may occur.
2. Donation Cancellations
2.1. Before Processing: If you wish to cancel a donation, you must contact us immediately at kindlytheproject@gmail.com. If the donation has not yet been fully processed by our payment gateway (e.g., Razorpay) and disbursed to the beneficiary or campaign, we may be able to cancel it. However, due to the nature of online payment processing, we cannot guarantee cancellation once a transaction is initiated.
2.2. Recurring Donations: If you have set up a recurring donation, you can cancel future scheduled donations by [Explain how to cancel, e.g., "accessing your user account settings on the Platform" or "contacting us at kindlytheproject@gmail.com at least [X] business days before the next scheduled payment date."] Cancelling a recurring donation will stop future payments but will not automatically refund past donations.
3. Refund Policy
As stated above, donations made through the Kindly platform are generally considered final and non-refundable. - Technical Error: If a donation was made in error due to a clear technical fault on our Platform (e.g., a duplicate transaction caused by a system glitch). You must notify us at kindlytheproject@gmail.com within 48 hours of the erroneous transaction with supporting evidence.
- Unauthorized Transaction: If a donation was made using your payment information without your authorization (fraudulent transaction). You must first report this to your payment provider (credit card company, bank). If, after their investigation, they confirm an unauthorized transaction that occurred through our Platform, you should provide us with their official report by contacting us at kindlytheproject@gmail.com.
- Campaign Misconduct (Exceptional Cases): [This is a very sensitive area. Be extremely careful with wording and consult legal advice. Example: "In extremely rare cases where a campaign is proven to be fraudulent by law enforcement or a formal legal judgment, and funds have not yet been fully disbursed by CreateTogether Foundation, we may, at our discretion and to the extent possible, attempt to facilitate a return of undisbursed funds to donors of that specific campaign." Or, you might state you don't handle this at all and it's between the donor and the campaign creator/payment processor after disbursement.]

We will not issue refunds for donations in cases such as:
- Change of mind by the Donor.
- Disagreement with the cause or how the Beneficiary ultimately uses the funds (unless it falls under proven fraudulent activity as outlined above).
- The campaign not reaching its fundraising goal.
4. Requesting a Refund
To request a refund based on the limited circumstances outlined above, please contact us at kindlytheproject@gmail.com within 7 days of the donation date (unless a different period is specified for a particular circumstance, like technical errors).
Your request must include:
- Your full name and email address associated with the donation.
- The date of the donation.
- The amount of the donation.
- The name of the campaign or cause you donated to.
- A clear explanation of why you are requesting a refund, with any supporting documentation (e.g., proof of technical error, report from your payment provider for unauthorized transactions).
We will review all refund requests on a case-by-case basis. Submission of a request does not guarantee a refund. We reserve the right to approve or deny any refund request at our sole discretion, in accordance with this Policy and applicable laws.
If a refund is approved, it will typically be processed back to the original method of payment within 7-14 business days in India. Please note that payment processor fees or platform fees may not be refundable, even if the donation principal is refunded.
5. Platform Fees and Payment Processor Fees
Please note that any platform fees charged by CreateTogether Foundation are non-refundable, even if a donation is refunded. Furthermore, transaction fees charged by third-party payment processors like Razorpay are subject to the policies of those processors and may also be non-refundable.
6. Changes to This Policy
We reserve the right, at our sole discretion, to modify or replace this Policy at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to make donations after any revisions become effective, you agree to be bound by the revised policy.
